In compliance with Section 18 of the Occupational Safety and Health Act of 1970, the State of New Mexico runs a program for occupational safety and health under a contract with OSHA. On December 10, 1975, the New Mexico state plan was initially adopted, and on December 4, 1984, it was certified as a state plan.
States are required to uphold workplace safety and health standards that are “at least as effective” as corresponding federal requirements. States have the authority to enact regulations that are stricter than federal regulations of a similar nature or that include risks that are not covered by federal regulations. The Environmental Improvement Board, a seven-member body chosen by the Governor and with the authority to adopt, alter, or repeal OHS rules and regulations, must hold a public hearing before adopting new standards.
